TN Car Title Notary: When You Need One

The short answer

In most plain in-state private sales, Tennessee does not require the seller's title signature to be notarized. But the moment an out-of-state buyer, a power of attorney, a gift, an inheritance, a lienholder, or a dealer enters the picture, a notarized signature is usually the safest — and sometimes required — path.

When you DO need a TN notary for a car title

The buyer lives in a state that requires a notarized seller signature (Arizona, Kentucky, Louisiana, Montana, Nevada, North Carolina, Ohio, Oklahoma, Pennsylvania, West Virginia, Wyoming, and others).
You are signing as Power of Attorney for the title holder.
The vehicle is being gifted or transferred between family members.
The vehicle was inherited through an estate or affidavit of heirship.
A lienholder, lender, or dealer requires it.
The title is being corrected, replaced, or signed by more than one owner.

What to bring to the appointment

The original title (no copies, no photos).
A current government-issued photo ID for every signer.
The bill of sale, completely filled out but unsigned.
Any power-of-attorney paperwork, if applicable.
Cash, card, or check for the notary and travel fee.

Tip: do not sign the title or bill of sale until the notary is watching. A pre-signed document cannot be notarized in Tennessee.

Does a car title transfer need to be notarized in Tennessee?

For most in-state private sales between two Tennessee residents, the seller's signature on the back of a TN title does not have to be notarized. Notarization is required when the buyer is out of state and that state requires a notarized signature, when the title is being signed by power of attorney, when a vehicle is gifted or inherited, or when a lienholder or dealer specifically asks for it.

Does a Tennessee bill of sale need to be notarized?

Tennessee does not legally require a bill of sale to be notarized, but the county clerk will often ask for one when the title price is left blank or when the vehicle is gifted. Notarizing the bill of sale protects both the buyer and the seller and makes the title work go faster at the clerk's office.

What does a mobile notary need to see for a car title?

Every signer must be present in person with a current, government-issued photo ID (driver's license, TN ID, passport, or military ID). Bring the original title — not a copy — and the completed bill of sale. Do not sign anything until the notary is watching.

Can a notary fix a mistake on a Tennessee title?

No. A notary cannot cross out, correct, or alter information on a title. If the title has an error, contact the Tennessee Department of Revenue or your county clerk for a duplicate or correction form before scheduling the notarization.

Do both the buyer and seller have to be present for the notary?

Only the person whose signature is being notarized has to appear in front of the notary. For a standard TN title transfer that's usually the seller. If the buyer also needs a notarized signature (for an out-of-state title application, for example), they must appear too.
